May 15, 2024Davies Chocolates was founded in 1932 by Sidney Davies. Since its inception, the scrumptious and premium chocolate brand has seen several owners. Noel Kowald and his wife are current owners, but upon acquiring the business, he was surprised to discover that the purchase didn’t grant him legal ownership of the brand name “Davies Chocolates” because there were no trademark registrations in place.
It was by chance that he discovered he did not own his brand name. Noel was a member of a business networking group called BNI when he discovered, through a Trade Attorney, that his brand name wasn’t protected simply because of its longstanding history of use. When he acquired the business and its production facility, he assumed he automatically owned the brand name Davies Chocolates, given its decades-long presence in the market.
However, the Trade Mark specialist clarified that without trademark registration, he lacked legal rights to the name. This meant he could face expensive legal battles to establish and defend his brand against imitators. Now that he owns the trademark registration, he has the authority to take down copycat websites, social media pages, and prevent others from using the “Davies Chocolates” brand.
Today he owns six Davies Chocolates registered trade marks for the product and services he offers under this brand.
